We reserve the right to modify, suspend, or discontinue any part of the Services at any time without liability to you.

4. Health and Fitness Disclaimer

Participation in strength and conditioning training involves physical exertion and inherent risk. By using our Services, you acknowledge and agree that:

– You are voluntarily participating in physical activity and training programs that carry inherent risks, including but not limited to muscle strains, sprains, fractures, cardiovascular events, and in rare cases, serious injury or death.

– You confirm that you are in good physical condition and have no medical condition that would prevent your safe participation, or you have consulted a physician and received clearance to participate.

– You should consult a physician before beginning any new exercise program, particularly if you have any pre-existing medical conditions, injuries, are pregnant, or have concerns about your fitness to train.

– You are responsible for accurately disclosing any medical conditions, injuries, or limitations to your coach or trainer.

– We strongly recommend obtaining independent medical clearance before commencing training with us.

Your Athlete Hub is not a medical provider, and nothing in our Services should be construed as medical advice, diagnosis, or treatment.

5. Assumption of Risk and Release of Liability

By participating in any Services offered by Your Athlete Hub, you voluntarily assume all risks associated with such participation, known or unknown, and release, waive, discharge, and covenant not to sue Your Athlete Hub, its owners, coaches, employees, contractors, and affiliates from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained while participating in the Services, except where caused by our gross negligence or willful misconduct.

– Payment is due at the time of purchase or according to the billing schedule presented at checkout.

– Recurring memberships or subscriptions will automatically renew at the end of each billing cycle unless cancelled in accordance with Section 7.

– You authorize us (or our third-party payment processor) to charge your nominated payment method for all applicable fees.

– Failure to pay may result in suspension or termination of access to the Services.

– All fees are quoted in Australian Dollars (AUD) and are inclusive/exclusive of applicable taxes as noted at checkout.

7. Cancellations and Refunds

Any testimonials, before/after photos, or results shared on our website or marketing materials reflect individual experiences and are not guarantees of results. Individual results vary based on factors including effort, genetics, adherence, and starting condition. We make no guarantee of specific outcomes from participation in our Services.

10. Intellectual Property

All content on our website and within our programs — including text, graphics, logos, training programs, videos, and branding — is the property of Your Athlete Hub or its licensors and is protected by copyright and trademark law. You may not copy, reproduce, distribute, or create derivative works from our content without prior written consent.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use of your account.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Your Athlete Hub and its owners, employees, coaches, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Services. Our total liability for any claim arising out of or relating to these Terms or the Services shall not exceed the amount you paid to us in the 3 months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including liability for death or personal injury caused by negligence, where non-excludable).
